A Lagos Magistrate Court on Wednesday struck out the assault case against Comfort Emmason, the passenger accused of attacking an Ibom Air staff during a flight incident on Sunday.
At a brief hearing at the Samuel Ilori Courthouse, Ogba, Magistrate Olanrewaju Salami dismissed the five-count charge after the Lagos Airport Police Command opted to withdraw the case unconditionally.
Police prosecutor, Inspector Olubunmi Adeitan, informed the court that the withdrawal followed the emergence of new facts presented to the command after Emmason’s arraignment on Monday.
Lead defence counsel, Adams Otakpe, told the court he had no objection to the application for withdrawal.
In his ruling, Magistrate Salami accepted the submissions of both sides, struck out the charges, and ordered Emmason’s release. However, he cautioned the 26-year-old to always act with restraint, regardless of provocation, noting that her conduct had contributed to the incident.
Emmason’s arrest and arraignment had drawn public attention, with the case becoming part of a wider conversation on the handling of unruly passenger behaviour in Nigeria’s aviation sector.
