The Supreme Court has affirmed former Senate President, David Mark, as the National Chairman of the African Democratic Congress (ADC) in a major judgment that could influence political alignments ahead of the 2027 general election.
The apex court delivered the ruling on Thursday in a unanimous decision by a five-member panel led by Justice Mohammed Lawal Garba.
According to the court, the Abuja Division of the Court of Appeal exceeded its powers when it issued an order after it had already dismissed a suit filed by one of the factions within the party.
The Supreme Court held that the Court of Appeal’s directive to maintain the status quo ante bellum was a preservatory order that was wrongly granted in the circumstances of the case.
The court ruled that David Mark’s appeal succeeded in part, but dismissed the section challenging an earlier ex parte order made by the Federal High Court regarding service of court documents in the suit filed by aggrieved party members.
The Supreme Court further directed all parties involved in the dispute to return to the trial court for continuation of hearing on the matter.
Earlier, the Independent National Electoral Commission (INEC) had withdrawn recognition of the ADC executives led by David Mark, citing the Court of Appeal judgment.
